These terms apply to the use of the website, the app and all services of CuliQuiz B.V. By using our services you agree to these terms.

1. Definitions

  • CuliQuiz: CuliQuiz B.V., established at Vlielandstraat 2, 1506 ZK Zaandam, the Netherlands, CoC 92064213.
  • User: any natural or legal person who uses the website, app or services.
  • Customer: a User who enters a paid agreement with CuliQuiz.
  • Services: anything CuliQuiz offers, including the app, CuliQuiz Live, microlearning content, team battles and CRM/education integrations.
  • Content: all text, questions, images, audio, video and data offered through our services.

2. Applicability

These terms apply to all offers, quotations and agreements of CuliQuiz, unless agreed otherwise in writing. Any purchasing or other terms of Customers are explicitly rejected.

3. Our services

CuliQuiz is a microlearning platform for food, drinks and hospitality. We offer:

  • The CuliQuiz app for individual learners.
  • CuliQuiz Live: live quiz platform for classes and teams.
  • Tailored packages for brands, educators and hospitality businesses.
  • Access to learning environments via partners such as Learnstrike.

We may at any time adjust, expand or discontinue our services. Customers will be informed of substantial changes in good time.

4. Sign-up and account

Some services require an account. You are responsible for keeping your credentials confidential and for everything that happens under your account. Report misuse to info@culiquiz.nl.

5. Pricing, invoicing and payment

  • Prices are stated in the quote or agreement and exclude VAT unless stated otherwise.
  • Invoices are payable within 14 days of invoice date.
  • Late payment incurs statutory commercial interest plus collection costs.
  • CuliQuiz may adjust prices annually for inflation (CBS consumer price index). Other price changes will be announced at least 30 days in advance.

6. Right to use

You receive a personal, non-exclusive and non-transferable right to use the services for their intended purpose. You may not reproduce, resell or publicly disclose the Content without written consent.

7. Intellectual property

All intellectual property rights (copyright, trademark, database, software) on the website, app, Content and methodology rest with CuliQuiz or its licensors. Nothing in these terms or our services transfers these rights.

8. User obligations

You commit to:

  • Use the services only for the intended purpose and in compliance with the law.
  • Not upload or share content that is unlawful, offensive, misleading or infringing.
  • Not attempt reverse-engineering, scraping or circumventing security.
  • Not use the services to develop a competing product.

9. Liability

  • CuliQuiz strives for accurate and available services but makes no guarantees of uninterrupted operation or error-free content.
  • Total liability is limited to the amount the Customer paid in the 12 months preceding the damage, capped at € 25,000.
  • Indirect damage (including lost profit, data loss, consequential damage) is excluded.
  • Limitations do not apply in case of intent or wilful recklessness by CuliQuiz.

10. Force majeure

In case of force majeure (such as outages at hosting providers, networks or third parties), CuliQuiz is not obliged to fulfil its obligations. If force majeure lasts more than 30 days, either party may terminate the agreement.

11. Term and termination

  • Subscriptions run for the agreed term and renew tacitly unless cancelled at least 30 days in advance.
  • In case of non-payment, bankruptcy or serious breach, CuliQuiz may terminate immediately.
  • Termination does not affect amounts already due.

12. Privacy and data

Personal data processing is governed by our privacy policy.

13. Changes

CuliQuiz may update these terms. Updates will be announced at least 14 days in advance via email or website. You may object by terminating the agreement before the effective date.

14. Governing law and disputes

These terms and any agreements are exclusively governed by Dutch law. Disputes will first be addressed in good faith; if unresolved, the competent court is the District Court of Noord-Holland in Amsterdam, the Netherlands.
